Plain-language summary: Use Kahal lawfully and don't try to break it. Pay your invoice if you're on a paid plan. We provide the platform "as is" while we're in early stages, and either side can end the agreement. Israeli law governs. Questions: support@mykahal.com.
1. Who these terms are between
These Terms of Service ("Terms") form a binding agreement between you ("you", "Customer") and AmihaiTech, a sole proprietorship in Israel ("we", "us", "Kahal"). They govern your use of the Kahal platform, including the marketing site at mykahal.com and all organization subdomains.
By creating an account, joining an organization, or otherwise using the platform, you agree to these Terms. If you do not agree, do not use the platform.
2. The service
Kahal is a software-as-a-service platform that helps community centers manage spaces, classes, instructors, members, payments, and related operations. We may add, change, or remove features over time. We will give reasonable advance notice of material changes that meaningfully reduce functionality you depend on.
3. Accounts
- You must provide accurate information and keep it current.
- You are responsible for all activity under your account, including by anyone you invite or grant a role to.
- You must keep your sign-in credentials and magic-link emails confidential. If you suspect unauthorized access, notify us immediately at support@mykahal.com.
- You must be at least 16 years old (or the minimum age in your jurisdiction) to create an account.
4. Roles and responsibilities
- Organization admins control the configuration of their organization, the data they collect, and the people they invite. They are the data controllers for member data they enter into Kahal.
- Instructors and members use the platform under the organization that invited them.
- Kahal is the data processor for organization data; see the Privacy Policy.
5. Acceptable use
You agree not to:
- Use the platform for any unlawful purpose, or to violate any third party's rights.
- Upload malicious code, attempt to probe or breach security, or interfere with other customers.
- Reverse-engineer, scrape, or resell access to the platform without written permission.
- Send spam, chain letters, or unsolicited marketing using Kahal's email or notification features.
- Misrepresent your identity or impersonate another person or organization.
- Use the platform to collect or process data you have no lawful basis to process.
We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.
6. Plans, fees, and payment
- Kahal offers a Free plan (currently capped at 20 users per organization) and a Pro Unlimited plan billed monthly or annually. Current pricing is shown on the pricing page.
- Paid plans renew automatically at the end of each billing period until cancelled. You can cancel at any time from your settings or by emailing support; cancellation takes effect at the end of the current billing period.
- Fees are non-refundable except where required by law (including any cooling-off rights under the Israeli Consumer Protection Law where they apply). If you cancel a monthly plan mid-cycle, you keep access until the period ends; we do not refund partial months. For annual plans, we do not refund the unused portion on cancellation.
- If you are on a recurring subscription and need to step back temporarily, you may freeze (pause) your subscription instead of cancelling. While frozen, recurring billing is paused and the platform enters a read-only state for your organization; you can resume at any time and pick up where you left off. No refunds are issued for the frozen period.
- We may change pricing with at least 30 days' notice; new pricing applies from your next billing period.
- For payments collected by you from your members through Kahal, a clearing fee is charged by your chosen payment provider — Sumit or HYP (היפ) — and deducted by the provider at settlement; rates are set by the provider — see the payment-gateway configuration screen for the current rate that applies to you. HYP additionally charges a one-time setup fee payable directly to HYP on activation. Kahal takes no cut of the payments you collect from your members. Current rates are also shown on the payment-gateway configuration screen.
- You are responsible for any third-party clearing-fee VAT (Israeli VAT on your payment provider's clearing fee, where applicable). AmihaiTech is registered as Osek Patur and does not collect VAT on its subscription fees.
7. Your data
You retain ownership of all data you upload to Kahal ("Customer Data"). You grant us a limited licence to host, process, transmit, and back up Customer Data solely as needed to operate the service for you. We will not sell or use Customer Data for advertising. Our handling of personal data is described in the Privacy Policy, which is incorporated into these Terms.
On request — and on termination — we will provide a reasonable export of Customer Data in a machine-readable format. After termination, we may delete Customer Data after 90 days unless retention is required by law.
8. Beta features and early-stage service
Kahal is currently in active development. Some features are marked or are evidently in beta. Beta features are provided "as is" and may change or be removed without notice. We work hard to keep the platform reliable, but we do not currently offer a contractual uptime SLA.
9. Third-party services
Kahal integrates with the following third-party services to deliver the platform:
- Payment processing & invoicing: Sumit or HYP (היפ) — each organization chooses one of these providers, which processes member payments collected through Kahal and issues tax invoices on the organization's behalf.
- Hosting & infrastructure: Hetzner (servers in the EU) and Cloudflare (edge, DNS, and TLS termination).
- Email delivery: Resend — sends transactional emails such as magic links, invitations, and notifications.
- Product analytics & session replay: PostHog Cloud (EU region) — processes analytics events and, with your consent, session recordings to help us measure usage and improve the platform.
- Authentication: Google — when you choose to sign in with Google OAuth.
Your use of those services is also governed by their own terms and privacy policies. We are not responsible for the acts or omissions of third-party providers, including any service interruption, fee change, or policy change on their side. If a third-party provider becomes unavailable or changes materially, we may substitute an equivalent provider; we will give reasonable notice where a substitution affects you.
10. Intellectual property
Kahal, the Kahal name and logo, the platform's source code, design, and documentation are owned by AmihaiTech and protected by intellectual property law. Nothing in these Terms transfers any of those rights to you. You may not copy, modify, or create derivative works of the platform except as expressly permitted.
11. Disclaimer of warranties
To the maximum extent permitted by law, the platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or secure against every threat.
12. Limitation of liability
To the maximum extent permitted by Israeli law, neither party will be liable to the other for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or loss of data, arising from or related to these Terms or the platform.
Our total aggregate liability for any claim arising under these Terms will not exceed the greater of: (a) the fees you paid to us in the 12 months preceding the event giving rise to the claim, or (b) ILS 1,000.
Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for fraud or for death or personal injury caused by negligence).
13. Indemnity
You agree to indemnify and hold us harmless from any third-party claim arising from (a) your breach of these Terms, (b) your unlawful use of the platform, or (c) Customer Data you upload that infringes a third party's rights or violates applicable law.
14. Suspension and termination
- You may stop using the platform and close your account at any time.
- We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the platform in a way that risks harm to us, other customers, or third parties.
- On termination, your right to use the platform ends immediately. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnity, and governing law) will survive.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email or by a notice on the platform at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms. The "Last updated" date at the top reflects the most recent revision.
16. Governing law and jurisdiction
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-laws principles. The competent courts of Tel Aviv-Jaffa, Israel, will have exclusive jurisdiction over any dispute arising under or in connection with these Terms, except that we may seek injunctive relief in any court of competent jurisdiction.
17. Miscellaneous
- If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.
- Our failure to enforce any provision is not a waiver of our right to enforce it later.
- You may not assign these Terms without our prior written consent. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.
- These Terms, together with the Privacy Policy and any plan-specific terms, are the entire agreement between you and us regarding the platform.
